BEM Conversation Guide: Conducting the First Meeting in Six Steps
The invitation has been accepted, the date is set. Now someone who was ill for weeks is sitting across from you — and you are supposed to have a conversation that helps without pressuring. A guide takes away the uncertainty: it sets the order and reminds you of what is easy to forget in the conversation.
How does a good first BEM meeting go?
1. **Set the frame:** A place without an audience, an hour of time, participants agreed in advance. The person has a say in who attends. 2. **Explain the purpose:** The aim is to overcome the incapacity for work and prevent it from recurring (§ 167 Para. 2 SGB IX, German law) — not control and not a dismissal. 3. **Stress that it is voluntary:** Every step needs the person's consent. They can end the BEM at any time; they will not be penalized for doing so. 4. **Listen rather than ask:** What is making work difficult right now, what would help? You do not ask about the diagnosis. If the person brings it up on their own, it still does not go into the record. 5. **Collect ideas:** Working hours, workplace, tasks, graduated return to work, support from the company doctor, the integration service (Integrationsfachdienst) or rehabilitation providers. 6. **Agree and write it down:** Who does what by when, and when will you talk again? The person receives a copy.
Who attends?
German law names the employee representatives (works council or staff council), for severely disabled employees the representative body for severely disabled employees, and the company doctor where necessary. The person may bring a person of trust of their choice. They have a say in who takes part in each individual case — fewer is often better.
What goes into the record — and what does not?
Topics, agreed measures, responsible persons, next appointment. No diagnoses, no medical findings, no judgments. The BEM file is kept separate from the personnel file; the personnel file only contains the offer, consent or refusal, and the agreed measures.
How it works in EasyBGM
Every open BEM case has a “Record conversation” button. Next to it, a conversation guide opens with exactly these steps: explanations of each role, questions you can ask and ones you should avoid, suggestions for measures and a note on what goes into the record. The legal assessment of each individual case stays with you — for difficult cases, bring in professional support. The guide Conducting a BEM Meeting explains every step in detail.
